Terms and Conditions of Supply (Website Sales)

Thank you for choosing Drinkmaster. Please read the terms below before placing your order.

We want everything you order from us to reach you in perfect condition and for you to be happy with the goods you receive. However, we understand that there may be instances when you wish to cancel an order with us. With this in mind, here are all the details you need to know before buying from us.

Delivery Details

Your order will be dispatched via courier, so a signature will be required. It will arrive within 5 working days from receipt of your order. Our courier does not deliver to businesses on Saturdays or Sundays. On occasion (and outside of our control) they may deliver on Saturdays to domestic addresses.

Special deliveries

If you need your drinks “next day” please order before 2:30pm and choose your special delivery option.

If for any reason we are unable to guarantee next day delivery we will contact you.

  • Next day delivery charge on orders of more than £65: £8.95+VAT
  • Next day delivery charge on orders of less than £65: £18.90+VAT

We can’t guarantee next day deliveries in some postcode areas. These are:

AB, DD8-11, KW15-17, ZE1-99, GY1-99, JE1-99, PA20-40, PH19-26, PH30-35, PH49-50, HS9-99, PA41-49, PA60-61, PA75-78, , 30-44, HS1-8, IV1-56, KW1-14, IM, TR21-25, BT, EIRE/ROI.

Tracking your Parcel

You can track your parcel online, you will need to log in.

We can track your parcel for you and check signature details if it has been delivered. Just call 0800 373 515, we’ll be happy to help.

We try to ensure all drinks are in stock. If when you place your order we feel we will not be able to send it to you to arrive within 5 days we will contact you by telephone or email to advise you of a delivery date and ask whether you wish to proceed with the order.

It is very rare for an order not to arrive. Please advise us within 14 days from order if your goods are not delivered.

If there is a problem with your order please let us know as soon as possible, within 14 days of the delivery date and we will discuss it with you and either rectify the problem, provide replacement goods or a full refund (including delivery costs.)

When you place an order with us we will send a confirmation email which will include details of your order. If there is any discrepancy please let us know as soon as possible, preferably within 24 hours.

Pricing

The price of the goods will be as set out in the checkout page, or as advised by telephone or email if you / your company has a special agreed price list with non-published prices. If you / your company has a special price list, those prices that are agreed with you will not be published on the web site, even if you have logged in to your account.

Terms of Payment

If you / your company has previously agreed special terms with Drinkmaster we will charge you according to the details of those terms.

If you are paying for goods online and paying with a credit / debit card we will take payment from the card on the assumption that you are entitled to make payments with it. If we are advised by our card authorisation provider of any concerns about your transaction we will take whatever action is appropriate based on their advice.

Terms and Conditions of Supply (Non-Website Sales)

  1. Definitions - For the purpose of these terms and conditions
    1. “the Goods” refers to any Goods to be supplied by Drinkmaster Ltd. b. “the Seller” refers to Drinkmaster Ltd. and
    2. “the Purchaser” refers to the buyer of the Goods.
  2. Terms of Payment
    1. The Seller shall invoice the Purchaser upon receipt of a verbal or written order for the Goods. All invoices are payable within 7 days of the date of the invoice, unless otherwise agreed in writing prior to despatch. Purchasers who prefer to pay accounts using Bank Automated Clearance Services should quote:

    2. Without prejudice to its other rights and remedies hereunder and at law the Seller reserves the right to charge the Purchaser interest in respect of late payment of any sum due hereunder (both before and after any judgement) at the rate of 2 per cent per annum over The Cooperative Bank base rate from time to time from the due date for payment until payment of principal plus interest in full.
  3. Delivery of the Goods
    1. Each order shall constitute a separate contract and any failure or default of the Seller in respect of any one delivery shall not entitle the Purchaser to treat the contract as a whole as repudiated.
    2. The Seller shall deliver the Goods within a reasonable time and shall if possible comply with any reasonable stipulation of the Purchaser as to the time of delivery. The Seller shall not be under any liability as a result of delay in delivery or for any consequences of such delay.
    3. The Goods will be despatched by the Seller or by independent carrier at the Seller’s expense (subject to any minimum order value that the Seller may apply) and risk only when using the Seller’s usual means of delivery.
    4. Failure to accept delivery shall not delay payment and may result in charges for handling and storage until delivery is accepted.
  4. Claims for Goods
    1. Claim for damage, loss or pilferage in the case of Goods must be made within 7 days of their receipt. Damaged or evidence of pilfered Goods must be held by the Purchaser for disposal or return instructions.
    2. If the Purchaser does not so notify the Seller in accordance with this clause the Purchaser shall be deemed to have accepted the Goods.
    3. The Seller’s liability in respect of any Goods found to be defective is limited to the replacement of these Goods provided that the defective Goods are returned or placed at the Seller’s disposal.
  5. Price Lists
    1. A price list is not an offer but an invitation to the Purchaser to make an offer on the terms and conditions set out herein and on the price list.
    2. Prices are subject to alteration without notice and orders received from a Purchaser will be accepted at the prices current at the date of order.
  6. Title to Goods
    1. Property in the Goods shall not pass to the Purchaser until the Seller has received payment in full for the price of the Goods and all other sums then due from the Purchaser to the Seller.
    2. Risk of damage to or loss of the Goods shall pass to the Purchaser upon delivery of the Goods at the Purchaser’s premises.
    3. Until such time as property in the Goods passes to the Purchaser the Seller shall be entitled to, without notice or liability, at the Purchaser’s expense and without prejudice to any legal remedy, at any time require the Purchaser to deliver up the Goods to the Seller and if the Purchaser fails to do so forthwith, to enter upon the Purchaser’s premises or the premises of any third party where the Goods are stored and recover the Goods.
  7. Insolvency
    1. If the Purchaser goes into liquidation, becomes bankrupt, or becomes the subject of an administration order, or a receiver is appointed over any of its property or assets, or makes any voluntary arrangements with its creditors, or ceases or threatens to cease to carry on business, the Seller shall be entitled to recover all of the Goods that belong to the Seller and the Purchaser shall not impede this payment in any way.
  8. Liability
    1. The following provisions set out the Seller’s entire liability (including any liability for the acts and omissions of its employees, agents and sub-contractors) to the Purchaser in respect of:
      1. any breach of the Seller’s contractual obligations arising under this agreement.
      2. any representation, statement, act or omission including negligence arising under or in connection with this Agreement any such act or omission shall be known as “an Event of Default”.
    2. The Seller’s liability for death or personal injury resulting from its own negligence or that of its employees, agents or sub-contractors, shall not be limited.
    3. Subject only to 8(b) the Seller shall not be liable to the Purchaser for loss of profits or any other indirect or consequential losses howsoever arising.
    4. Subject only to 8(b) the Seller’s entire liability in respect of any Event of Default or series of connected Events of Default shall be limited to the price of the Goods.
  9. These conditions shall be governed by and construed in accordance with English law.

Returns policy

Our products are classified perishable items, and as such we are unable to accept returns or offer refunds (https://www.gov.uk/accepting-returns-and-giving-refunds) unless the items are faulty. If the items are faulty you have 7 days from the day after delivery of your order to notify us. Please do so in writing (an email, fax or letter.) We will acknowledge your communication in writing also. We will refund the value of your order in full including delivery costs, within 30 days of notification that your items are faulty. Depending upon the circumstances and volume of goods you have ordered we may choose to arrange for the goods to be collected by our courier. This will be at our expense. We are not obliged to refund the value of all goods that have been consumed or opened, although we appreciate that in order to fully inspect and assess items you purchase from us you will need to remove the seals on some products.

Your statutory rights are not affected.

We will never share you data with any other company or individual. We will use your data to contact you about your order. If you choose to receive marketing communications from us we will contact you in line with your preferences. In practise we tend to send monthly marketing emails and won’t burden your in-box with too much communication. We usually send details of new products and special offers. You can opt out of receiving marketing information from us at any time.
